Requirements for Using our Services
In order to utilize our services, every client must complete an online profile for both the client and dog, as well as read and sign our waiver. Owner certifies to the accuracy of all information given about said pet in this contract and accompanying registration form and specifically represents that he or she is the sole owner of the pet, free and clear of all liens and encumbrances. Additionally, each dog must remain current with all vaccinations as required by the NYC Department of Health and wear an identification tag at all times. We also require that dogs are suitable for our unique environment, including being safe with other dogs and our staff. We test for this initially through our rigorous temperament testing process, but we also continuously evaluate dogs for safety. Note that an initial pass of the temperament test does not guarantee access to the daycare if our staff determines that the safety of our dogs or staff are at risk.
We require these things of all dogs so that we can provide them with the best experience possible and so that you can know that we are doing all that we can to ensure the health and safety of your dog and our staff in the context of our cage-free and off-leash environment. Please note that unless otherwise noted in writing all services and products are non-refundable. For more information, please reach out with any questions that you might have.
Grooming Waiver
To the extent that an Owner opts to have their dog receive grooming services from the Facility, the Owner indemnifies and holds PupCulture and its officers, directors, shareholders, trustees, parent companies, subsidiaries, affiliates, predecessors, successors, assigns, representatives, and agents harmless with respect to any and all claims, demands, suits, manner of obligation, debt, liability, tort, covenant, contract, or cause of action of any kind whatsoever, at law or equity, whether accrued or not accrued, including without limitation, all claims and causes of action arising out of or in any way relating to all acts of behavior of said pet while it is in the care and custody of PupCulture. The owner of any pet receiving grooming treatments is responsible for the behavior of the pet and any fees incurred by its behavior, should the pet bite another animal or person. Should any injury occur during your pet’s grooming, PupCulture is neither financially nor legally responsible.
Note that following a Grooming Appointment the skin under a severely tangled or matted coat can become very irritated and sensitive. It may be red, swollen or even cracked. There is also a much higher chance of nicking or cutting a dog’s skin during de-matting or clipping such a coat. It is possible for the effects of matt clipping procedures to appear after grooming. This may include, but is not limited to, the following: itchiness, redness, or self inflicted irritations/abrasions from excessive rubbing/scratching. After shaving off a coat that has been left unattended for some time, a dog’s skin will be very sensitive. The problem is not caused by the grooming procedure, but is a result of the matting. Regular brushing and combing will eliminate these potential problems.
Pick Up & Drop Off Waiver
The terms of my Membership Agreement with PupCulture, its affiliates, and its subsidiaries (“PupCulture”) are incorporated herein. I agree to pay for pick-up and/or drop-off services when they are reserved or rendered. I authorize PupCulture to charge balances for past due services to the credit card listed on my Membership Agreement.
1. I understand that pick-up and drop-off services are subject to availability and must be reserved in accordance with PupCulture’s policies. I understand that PupCulture reserves the right to refuse pick-up or drop-off services in its sole discretion.
2. I authorize PupCulture and its employees to enter my premises in order to pick my dog(s) up and/or drop my dog(s) off. If I wish to revoke such consent, I may terminate this Pick-Up + Drop-Off Service Agreement by expressly notifying PupCulture in writing.
3. I have provided or will provide PupCulture with all keys and devices necessary to enter my premises, regardless whether my premises is attended by a doorperson or other individual. I understand that PupCulture may duplicate such keys and devices, but will keep all keys, devices, and duplicates thereof in a locked and secure location at PupCulture.
4. I will comply with all applicable laws with respect to my premises. I will ensure that my premises are safe and suitable for PupCulture employees to enter. I represent that I either own my premises or have authority to permit PupCulture employees to enter them.
5. Except to the extent caused by PupCulture’s gross negligence, bad faith, or intentional misconduct, I agree to hold harmless and indemnify PupCulture and its principals and employees from all liabilities, financial or otherwise, for injuries to myself, my dog(s), PupCulture employees, or my property, which may arise from services rendered by PupCulture or as a consequence of my or my dog's association with PupCulture.
6. Except to the extent caused by PupCulture’s gross negligence, bad faith, or intentional misconduct, I waive, to the maximum extent permitted by law, any and all claims, actions, or demands of any nature, either foreseen or unforeseen, that I may have against PupCulture and its principals and employees in connection with the services described herein.
By signing, I acknowledge that I have read this agreement and release of liability in its entirety and agree to its terms. I understand that this agreement shall control every time PupCulture renders pick-up and/or drop-off services on my behalf.
Vaccination Requirements
The health of the dogs in our care is our number one priority. To that end, we require that all dogs using any PupCulture service be currently vaccinated against rabies, distemper, hepatitis (adenovirus), parainfluenza, parvo and bordetella. That commonly means that you need the following vaccinations administered by a veterinarian:
Rabies (Requires a certificate on the veterinary clinic letterhead, signed by a veterinarian with: Given and expiration date, lot number of the given vaccine, and manufacturer of the given vaccine.)
Bordetella (Please note that as required by the NYC Department of Health, your dog must receive the Bordatella vaccine annually. This vaccine is intended to prevent the spread of bacteria that can lead to what is commonly known as kennel cough. Please note that there are many strands of “kennel cough”, and the vaccine only covers some of those strands, therefore it is possible for your dog to contract symptoms even if he is vaccinated.)
DHPP
Please consult with your veterinarian to ensure that you have the proper vaccine coverage. Please note that for puppies, this means that your puppy must be up to date with their current series based on their age. We require a vaccination certificate on the veterinary clinic letterhead, with given expiration dates for all other vaccines/wellness items administered to the dog; we keep records of your dog’s vaccination expiration dates to help you keep your dog current with his or her vaccinations.
The vaccination requirements shall not apply to any animal where, licensed veterinarian has determined that the vaccination will adversely affect the animal's health. We accept Titters or Vet exceptions, where signed by a certified Veterinarian, and accepted by the city and state of New York.
Sick Dogs
All dogs using our services must be healthy, as we care for a large number of animals. We will not admit any dog that we believe, at our sole discretion, to be a risk to the other animals in our care. It is your responsibility as a parent to notify us of any health related issues affecting your dog so that we can make an informed determination about how to best care for your dog. Customers that do not inform us in a timely manner of any health issues, knowingly bring their dog to us while he or she is sick, or do not make all efforts possible to remove their dog from our facility once determined to be a risk by us may be, at our discretion, disallowed from use of our services and will forfeit any unused portion of their membership or packages without a refund.
Injuries
While we make every effort to ensure that each dog in our care is as safe as possible, injuries can occur. If your dog is injured while in our care for any reason, and requires outside medical attention that our veterinarian cannot provide on-site, we will take your dog to one of the emergency hospitals in New York City (Animal Medical Center, Fifth Avenue Veterinary Hospital, or New York Veterinary Specialists) that specialize in emergency and critical care. Our first priority will always be the care of your dog and therefore getting them to a top hospital quickly will be our first step. If your pet, while under PupCulture’s care or supervision, bites another dog on the PupCulture premises or under PupCulture care or supervision, and such bite results in an injury that requires veterinary care, PupCulture will contact the owner of the bitten dog and upon written request of the bitten dog’s owner, PupCulture will promptly divulge in writing (1) the name of your pet, (2) your name and contact information, (3) and any medical information necessary for the health and safety of the bitten pet. Under all circumstances, the health of your dog is our first priority and we will make every effort possible to make sure he or she is safe and receives the proper care.
If pet becomes ill or if the state of the pet's health otherwise requires professional attention, the Facility, in its discretion may engage the services of a veterinarian or administer medicine or give other requisite attention to the pet and the expenses thereof shall be paid by the Owner. Owner gives consent to the Facility to act on Owner's behalf in obtaining emergency or any veterinary care at Owner's expense if deemed necessary by the Facility or any of its employees. Owner indemnifies and holds the Facility harmless for said expenses.
Please be advised that all dogs at PupCulture play at their own risk!
Services & Terms
As a Client of PupCulture I agree to the following terms:
Representatives of PupCulture are permitted to take any action they deem reasonably necessary to ensure the safety, security and health of my dog(s). Furthermore, representatives of PupCulture are permitted to walk my dog off-premises in public streets and in the vicinity of one of our locations.
As a client, I acknowledge that my dog(s) acceptance into the daycare program is not a guarantee of service in the future. We reserve the right to limit any dog(s) attendance to daycare based on our staff’s judgment.
I acknowledge that, except to the extent caused by PupCulture’s gross negligence, bad faith, or intentional misconduct, I agree to hold harmless and indemnify PupCulture and its agents and employees from all liabilities, financial or otherwise, for injuries to myself, my dog(s), or my property, which may arise from services rendered by PupCulture or as a consequence of my or my dog’s association with PupCulture.
Representatives of PupCulture are permitted to bring my dog(s) freely to other affiliate locations for the purposes of boarding. We at PupCulture will never provide boarding at any of our locations without constant 24/7 supervision of a representative or staff member. While we have permission to freely board our dogs at any of our affiliate locations, we will always notify you, our client, of where your dog will be for the purposes of a boarding visit. If a pet left in daycare is not picked up by advertised closing time listed on Facility’s website and on the Facility’s premises Owner agrees that the said pet will stay for boarding. Owner further agrees that earliest the pet may be picked up is the next day’s advertised opening hours. Owner agrees to pay all charged incurred.
We will never release your dog(s) to anyone other than yourself, the client, or an authorized emergency contact who we have verified as the same individual whose information was provided by the client. In the case of an emergency, or an unforeseen delay, we kindly request that you reach out to our team and provide the full name of any individual you may want to further authorize for pick up of your dog(s). We will verify this individual’s identity by requiring a valid form of ID, before releasing you dog(s) to that individual.
The Facility shall exercise reasonable care for the pet delivered by the Owner to the Facility for day care, grooming, and/or bathing. Owner indemnifies and holds Facility and its officers, directors, shareholders, trustees, parent companies, subsidiaries, affiliates, predecessors, successors, assigns, representatives, and agents harmless with respect to any and all claims, demands, suits, manner of obligation, debt, liability, tort, covenant, contract, or cause of action of any kind whatsoever, at law or equity, whether accrued or not accrued, including without limitation, all claims and causes of action arising out of or in any way relating to all acts of behavior of said pet while it is in the care and custody of the Facility. The Owner expressly agrees to be solely responsible for any and all acts of behavior of said pet while it is in the care of the Facility. Owner assumes any expense or liability for injuries that Owner's pet may inflict upon any human or other pet while in the custody and control of the Facility. It is further agreed by Owner that Facility's liability shall in no event exceed current chattel value of a pet of the same species of the pet left at the Facility. All charges incurred by owner shall be payable when billed by Facility at the address listed in this contract. The Facility shall have, and is hereby granted, a lien on the pet for any and all unpaid charges resulting from boarding, daycare, grooming, bathing or any other service provided by Facility.
